Dear {owner_first_name},

Public records show a notice filed on your home at {property_address}. I'm a local home buyer in {city}, not your lender, and I wanted to share some options in case they're useful.

Homeowners in this situation usually have several choices: catching up on the payments (reinstatement), asking the lender for a modification or repayment plan, talking with a free HUD-approved housing counselor, selling with an agent, or selling quickly to a buyer like me.

If you have equity in your home, selling before a foreclosure sale can protect that equity and your credit. If selling makes sense, I can buy as-is and close quickly or on your timeline.

Whatever you decide, I hope this helps. Call or text if you have questions. There's no cost or obligation.

Sincerely, {your_name} · {your_phone}

Respects their equity

It points out that selling before the auction can protect their equity and credit.

Dear {owner_first_name},

I wrote recently about your home at {property_address}. I know this can be a stressful time, and I don't want to add to it.

If you're still weighing your options, I'm glad to walk through what a sale would look like: what you'd likely walk away with, how quickly it could close, and what happens with the loan. It's a 15-minute conversation, and you're under no obligation.

Sincerely, {your_name} · {your_phone}

Dear {owner_first_name},

Records show a sale date of {sale_date} for {property_address}. If you've already worked something out with your lender, I'm glad, and please disregard this letter.

If not, there may still be time to sell and keep your equity. I can close quickly, buy the home as-is, and work with your lender on the payoff. Please call me or a HUD-approved housing counselor soon so you have time to choose.

Sincerely, {your_name} · {your_phone}

How to write a pre-foreclosure letter that's honest and effective

A pre-foreclosure letter goes to a homeowner whose lender has recorded a notice of default, notice of sale, or lis pendens, but whose home hasn't been sold at auction. These owners often receive dozens of letters, many designed to look official or urgent. Some come from "foreclosure rescue" scams that charge fees and deliver nothing. Your letter has to look and feel completely different.

Honesty is the strategy. Explain who you are, a local buyer and not their lender, and lay out their real options: reinstating the loan, asking for a modification or repayment plan, talking with a free HUD-approved housing counselor, selling with an agent, or selling to you. Including options that don't involve you is what makes the letter credible. Owners call the person who explained things clearly.

Equity is the key point. If the owner has equity, selling before the foreclosure sale lets them keep it, pay off the loan, and protect their credit. Many owners don't realize how much they could lose at auction. Filter your list for equity before you mail, and don't send purchase offers to owners who are underwater; they need a short sale or loss-mitigation help instead.

Tone matters. Avoid red ink, "final notice" headlines, countdown clocks, and words like "distressed". Don't mention the default amount or imply you know more about their finances than you do. Keep it calm, factual, and brief.

Timing follows the foreclosure process. Send the first letter soon after the notice is recorded, follow up every few weeks, and send a clear, factual letter once a sale date is set. Stop immediately if the case is cancelled or the owner asks you to. Spur can schedule the sequence and drop owners whose notices are rescinded.

Finally, make it easy to verify you. Include your full name, a local phone number, and a business address or website the owner can check. People in default are rightly wary of anyone who contacts them out of the blue. A letter that invites them to look you up, and doesn't ask for money or personal information, is far more likely to get a call.

Compliance note. Several states regulate equity purchasers and foreclosure consultants, including required contract language and cancellation rights (California's Home Equity Sales Contract Act is one example). Never imply you're a lender or government program, never charge upfront fees, and never promise to stop a foreclosure. Read the compliance checklist →

Pre-Foreclosure Letter Template questions

What should a pre-foreclosure letter say?

Who you are, that you're not the lender, the owner's real options including a HUD-approved counselor, how a sale can protect their equity, and a no-pressure way to reach you.

Is it legal to send pre-foreclosure letters?

Yes, but some states regulate equity purchasers and foreclosure consultants. Check your state's rules, never charge upfront fees, and never promise to stop a foreclosure.

When should I send a pre-foreclosure letter?

Soon after the notice is recorded, then every few weeks until the sale date, unless the case is cancelled or the owner asks you to stop.

Should I mail owners with no equity?

Not with a purchase offer. Underwater owners need a short sale or loss-mitigation help, so point them to their lender or a HUD-approved counselor.

Is this template free?

Yes. Copy or download it. Spur can fill in each owner's details, schedule follow-ups, and stop them when a case is cancelled.
